Terms of Service

Version 2.0 — effective from March 13, 2026

1. Service Provider

The provider of the RigBook service (website rigbook.app and mobile application RigBook, hereinafter jointly referred to as the "Service") is:

• "User" — a natural person who has created an account and uses the Service.
• "Content" — any data uploaded by the User to the Service, including tracks, events, comments, and ratings.
• "Track" — a recorded GPS trail including track points, events, tilt data, and surface information.
• "Premium Account" — a paid service tier with extended features.
• "Application" — the RigBook mobile application for iOS and Android.

3. Description of the Service

RigBook is a community platform for off-road enthusiasts that enables:

• Recording GPS tracks with real-time vehicle tilt monitoring
• Marking events and points of interest along the track (fords, obstacles, viewpoints)
• Browsing and searching public tracks of other users on the map
• Sharing tracks with the community or via a direct link
• Managing tracks, favorites, and ride statistics

The Service is provided "as is." The Provider reserves the right to modify, limit, or discontinue any feature of the Service at any time.

4. Registration and User Account

• Registration with a valid email address is required to use the Service.
• The User is obligated to keep login credentials confidential and to immediately notify the Provider of any unauthorized use of the account.
• Each User may have only one account.
• The Provider reserves the right to suspend or terminate accounts that violate these Terms.
• The User may delete their account at any time. Deletion is immediate and irreversible — all data including tracks will be permanently removed.

5. Paid Services (Premium Account)

• Certain features of the Service are available only with a Premium Account.
• Payments are processed exclusively through Apple App Store or Google Play Store. Payments are subject to the terms of the respective store.
• Prices are listed including VAT unless otherwise stated.
• Subscriptions renew automatically unless the User cancels at least 24 hours before the end of the current billing period.
• Refunds are governed by the Apple App Store / Google Play Store terms.
• The Provider reserves the right to change the scope of features included in the Premium Account. Users will be notified in advance of material changes.

6. User Content

• The User retains ownership rights to their Content.
• By uploading Content to the Service, the User grants the Provider a non-exclusive, royalty-free, worldwide license to display, store, and process the Content to the extent necessary to provide the Service.
• Public tracks may be displayed to other users on the map and in track listings.
• The User bears full responsibility for the accuracy and legality of the uploaded Content. The Provider is not obligated to verify the legality, accuracy, or timeliness of Content uploaded by users and bears no responsibility for such Content.
• The Provider reserves the right, but not the obligation, to remove Content based on reports or at its own discretion if there is a reasonable suspicion of a violation of these Terms or applicable law.

7. Acceptable Use

The User agrees not to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or harmful tracks and events
• Attempt unauthorized access to other users' accounts or the Service's infrastructure
• Abuse the event reporting system (reporting non-existent obstacles)
• Access the Service through automated means (scraping, bots) without the Provider's written consent
• Infringe on the intellectual property rights of the Provider or third parties

8. Off-Road Driving — Disclaimer

• Driver's responsibility — The User is always solely responsible for their decisions while driving. Data displayed in the Application (including other users' tracks, events, and tilt data) is informational and cannot replace the driver's own judgment.
• Legal compliance — The User is obligated to comply with all applicable laws of the country in which they are driving, including traffic regulations, environmental protection laws, trespassing restrictions, and protected area access limitations.
• Data accuracy — Tracks and events recorded by other users may not reflect the current state of the terrain. Conditions may change (floods, landslides, closures). The Provider does not verify and does not guarantee the accuracy or timeliness of Content uploaded by users.
• Tilt data — Roll and pitch values are indicative and depend on the phone's placement and calibration. They do not serve as a safety tool and cannot replace the vehicle's safety equipment.
• Risk — Off-road driving is an inherently risky activity. The User drives at their own risk. The Provider bears no liability for damages to health, property, or the environment arising in connection with off-road driving.

9. Limitation of Liability

• The Service is provided "as is" and "as available" without any warranties, express or implied.
• The Provider does not guarantee uninterrupted availability, error-free operation, or completeness of the Service.
• The Provider is not liable for data loss caused by technical failures, server outages, or force majeure.
• To the maximum extent permitted by law, the Provider's total liability to the User is limited to the amount the User has paid for the Service in the preceding 12 months, or EUR 50, whichever is greater.
• The Provider is not liable for indirect, incidental, special, or consequential damages.

10. Intellectual Property

• The RigBook brand, logo, interface design, Application and website source code are the exclusive property of PeNiVar s.r.o. and are protected by copyright and other legal regulations of the Slovak Republic and the EU.
• The User may not copy, modify, distribute, reverse-engineer, or otherwise exploit any component of the Service without the express written consent of the Provider.
• Map tiles are provided by Mapbox, Inc. and are subject to their terms of use.

11. Termination

• The User may terminate their use of the Service at any time by deleting their account.
• The Provider reserves the right to suspend or terminate the account of a User who repeatedly or seriously violates these Terms, without prior notice.
• Upon account termination, all User data is immediately and permanently deleted in accordance with the Privacy Policy.

12. Final Provisions

• These Terms are governed by the laws of the Slovak Republic.
• Any disputes shall be resolved by the competent courts of the Slovak Republic.
• If any provision of these Terms becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• The Provider reserves the right to amend these Terms. Users will be notified of changes at least 14 days in advance via email or an in-app notification.
• By continuing to use the Service after the changes take effect, the User agrees to the updated Terms.
