End User License Agreement (EULA)

Version 1.0 — effective from March 13, 2026

This End User License Agreement (hereinafter "EULA") is a legally binding agreement between you (hereinafter "User") and PeNiVar s.r.o. (hereinafter "Provider") governing the use of the RigBook mobile application (hereinafter "Application").

By installing, downloading, or using the Application, you agree to the terms of this EULA. If you do not agree to the terms, do not install or use the Application.

1. License Grant

The Provider grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install one copy of the Application on a mobile device that you own or control
• Use the Application for personal, non-commercial purposes in accordance with this EULA and the Terms of Service

The license applies to the current version of the Application and all future updates, unless an update is accompanied by a separate license agreement.

2. Restrictions

The User may not:

• Copy or distribute the Application or any part thereof to third parties
• Modify, adapt, or create derivative works from the Application or its source code
• Reverse-engineer, decompile, or disassemble the Application, except where expressly permitted by law
• Circumvent any technical protection measures in the Application
• Remove or alter copyright notices, trademarks, or other intellectual property notices contained in the Application
• Use the Application for commercial purposes (selling data, creating a competing product) without the Provider's written consent
• Rent, lend, or sublicense the Application to third parties
• Use the Application in a manner that violates applicable laws of any jurisdiction

3. Intellectual Property

• The Application including its source code, design, graphics, icons, text, sounds, and other elements is the exclusive property of PeNiVar s.r.o. and is protected by the Copyright Act No. 185/2015 Coll. and international intellectual property treaties.
• The "RigBook" brand, logo, and all related graphic elements are trademarks of PeNiVar s.r.o.
• This EULA does not grant you any ownership rights to the Application — it only grants a limited license to use it.
• Map tiles are the property of Mapbox, Inc. and are subject to their license terms.

4. Data and Privacy

The processing of personal data is governed by the Privacy Policy, which forms an integral part of this EULA.

The Application requires the following device permissions:

• Location (GPS) — for recording tracks. Location access is active only during track recording.
• Motion sensors (accelerometer, gyroscope) — for vehicle tilt monitoring.
• Internet connection — for track synchronization, map display, and server communication.

The User may revoke these permissions at any time in the device settings. Revoking location or sensor permissions will prevent recording new tracks.

5. Disclaimer of Warranties

• The Application is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• The Provider does not warrant that the Application will operate uninterrupted, error-free, or securely.
• Tilt data, GPS coordinates, and track information are indicative. Their accuracy depends on the device, its placement, and environmental conditions.
• The Application is not a safety device and must not be used as a substitute for the vehicle's safety equipment or the driver's judgment.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Provider shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from the use or inability to use the Application.
• The Provider shall not be liable for damages to health, property, or the environment arising in connection with off-road driving, regardless of whether the User was using the Application during the drive.
• The Provider's total liability is limited in accordance with the Terms of Service.

7. Termination

• This EULA is effective from the moment of installation of the Application and remains effective until terminated.
• The User may terminate this EULA at any time by uninstalling the Application and deleting their account.
• The Provider may terminate this EULA immediately if the User breaches any terms of this EULA.
• Upon termination, the User must cease using the Application and remove all copies from their devices.
• The provisions regarding intellectual property, disclaimer of warranties, and limitation of liability survive the termination of this EULA.

8. Changes to This EULA

The Provider reserves the right to modify this EULA at any time. Users will be notified of material changes through an Application update or in-app notification. By continuing to use the Application after changes are published, the User agrees to the updated EULA.

9. Governing Law and Dispute Resolution

• This EULA is governed by the laws of the Slovak Republic.
• Any disputes shall be resolved by the competent courts of the Slovak Republic.
• In case of conflict between this EULA and the Apple App Store or Google Play Store terms, the terms of the respective store shall prevail to the extent they relate to the distribution of the Application.

10. Final Provisions

• If any provision of this EULA becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Failure to exercise any right under this EULA does not constitute a waiver of that right.
• This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between the User and the Provider regarding the use of the Application.
